withYOUnity provides a digital messaging platform enabling families and loved ones to send personal video and audio messages to patients and residents in healthcare and care facilities.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Service.

4. Account Registration

You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update changes to your information
  • Accept responsibility for all activity under your account
  • Notify us immediately of unauthorized access

5. Acceptable Use

You agree not to:

  • Send messages containing threats, harassment, or abuse
  • Upload obscene, defamatory, or illegal content
  • Impersonate others or misrepresent your relationship to patients
  • Attempt to circumvent security measures
  • Transmit malware or harmful code
  • Interfere with the operation of the Service
  • Use automated systems without permission
  • Violate applicable laws or regulations

6. Message Content

Your Responsibility

You are solely responsible for all content you submit.

Facility Review

Messages may be reviewed by healthcare facility staff before delivery. Facilities may reject messages that violate their policies.

License

By submitting content, you grant withYOUnity a limited license to store, process, and transmit content solely for Service delivery purposes.

7. Healthcare Disclaimers

Not Medical Advice: We do not provide medical advice, diagnosis, or treatment.

No Patient Care Responsibility: Healthcare facilities maintain full authority over patient care decisions.

Facility Policies: Message delivery is subject to facility rules, patient status, and clinical judgment.

Voluntary Participation: Participation by residents and families is voluntary and subject to the policies of the participating healthcare facility.

8. Fees and Payment

If applicable, you agree to pay all fees associated with your use of the Service. Fees are non-refundable except as required by law or stated in our refund policy.

9. Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by withYOUnity and protected by intellectual property laws. "withYOUnity" and associated logos are trademarks of withYOUnity LLC.

10. Third-Party Services

Our Service may integrate with third-party services. We are not responsible for third-party content, policies, or practices.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant uninterrupted, error-free, or secure service.

12. Limitation of Liability

To the maximum extent permitted by law, withYOUnity shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless withYOUnity and its officers, directors, employees, and agents from claims arising from your use of the Service or violation of these Terms.

14. Termination

We may suspend or terminate access at any time for violation of these Terms or for any reason with reasonable notice.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey. Disputes shall be resolved in the courts of Bergen County, New Jersey.

16. Dispute Resolution

Before filing a lawsuit, you agree to attempt informal negotiation for at least 30 days.

17. Changes to Terms

We may modify these Terms at any time. Continued use constitutes acceptance. Material changes will be communicated via email or platform notification.

18. Severability

If any provision is unenforceable, the remaining provisions remain in full effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and withYOUnity.
